The Southworth Standard
Ten years ago, Scott Southworth challenged the UW-Madison student fee system in the Supreme Court. The ruling resulted in the conception of viewpoint neutrality, an idea that effectively forced the university to measure its funding decisions against the constitution. When the ruling was released, Southworth thought he lost the case. In reality, the case allowed student organizations to sue the university whenever they had funding disagreements.Today, in light of the new constitutional standard for funding decisions, many believe Southworth actually won the case.
